1. ELIGIBILITY.  The Promotion is open to people 21 years of age or older (as of date of entry) who are legal residents of the United States in which participation would be permitted under local laws and regulations. For avoidance of doubt, participants should check with local requirements regarding his or her eligibility prior to participation in this Promotion. The officers, directors, and employees of Lucky Bar Holdings, LLC dba Fifty Bar, and their subsidiaries and affiliated companies (“Fifty Bar”) and all advertising, promotion agencies, persons engaged in the development, production or distribution of materials for this Promotion (collectively the “Promotion Parties”) and immediate family members or persons living in the same household (whether related or not) are not eligible to participate in this Promotion.

2. PROMOTION PERIOD. The Promotion begins on January 27, 2025 at 12:00AM, PDT; ends on February 15, 2025 at 12:00AM, PDT (“Promotion Period”). Entries will be accepted through the Promotion Period.

3. HOW TO ENTER. Make a qualifying purchase of a full master case (40 5-packs) of each flavor across all Fifty Bar product lines and receive one entry into the sweepstakes.

To enter the Sweepstakes without making a purchase, follow these steps: Handwrite your full name, complete mailing address, email address, and phone number on a 3″ x 5″ piece of paper. Mail your entry in a standard, stamped #10 envelope to: Fifty Bar’s EV HUMMER GIVEAWAY AMOE Entry, 4500 S. Pleasant Valley Road, Suite 105, Austin, Texas 78744.

Each valid mailed-in entry will be counted as one entry into the Sweepstakes. Limit 1 entry per person, regardless of method of entry. Mail-in entries must be postmarked by 2/15/2025 and received by 2/22/2025 to be eligible. Incomplete or illegible entries will be disqualified. Entries submitted via automated methods are prohibited and will result in disqualification.

All entries, regardless of entry method, will have an equal chance of winning.

4. SELECTION OF WINNERS AND NOTIFICATION. Fifty Bar will randomly draw one (1) Winner from the eligible entries received after the Promotion Period closes, but no later than April 15th, 2025 12:00PM, PDT.  Odds of winning in the drawing depend on the number of eligible entries received.

Notification: Potential Winner(s) will be notified by Fifty Bar or its designated agency via the email provided in the entry form and must respond within a 24-hour time period from the date and time stamp the message was sent from Fifty Bar or its designated agency. If your reply is not received within the time requested, the prize will be deemed as undeliverable and will result in forfeiture. Fifty Bar will randomly select an alternate Winner. Winner may be required to sign and return an Affidavit of Eligibility, Liability Waiver and Publicity Release. The prize will be awarded within forty-five days after the Winner has been verified.

5. PRIZE AND PRIZE RESTRICTIONS. One (1) winner will receive their choice of: (A) 2024 EV Hummer with an approximate retail value (“ARV”) of $103,000.00. The winner will be solely responsible for all costs associated with the prize, including, but not limited to, federal, state, and local taxes, licensing, registration, and any additional fees or costs incurred at the time of acceptance of the vehicle. Delivery of the vehicle will be coordinated with the winner through Fifty Bar’s marketing department.

Sponsor does not make, nor is it responsible for, any representations, warranties, or guarantees, express or implied, in fact or in law, relative to the vehicle, including but not limited to its quality, mechanical condition, merchantability, or fitness for a particular purpose. The Sponsor is not responsible for any delays in the delivery of the vehicle due to manufacturing delays, supply chain issues, or other reasons outside of Sponsor’s control. The winner assumes all risks associated with the acceptance, possession, and use or misuse of the vehicle, including but not limited to property damage, personal injury, and death.

The winner agrees to release the Sponsor, its affiliates, subsidiaries, employees, and agents from any and all liability, claims, or damages arising out of or in connection with the acceptance, possession, use, or misuse of the vehicle. The Sponsor shall not be responsible for any accidents, injuries, or fatalities resulting from the use or operation of the vehicle.

(B) Product Prize Package: In lieu of the vehicle prize, the winner may opt to receive a product prize package consisting of: One (1) full master case (40 5-packs) of each flavor across all fifty (50) bar product lines. The ARV of the product prize package is approximately $60,000.00.

The prize must be accepted as awarded and cannot be transferred, substituted, or redeemed for cash, except at the Sponsor’s sole discretion. If the winner selects the vehicle prize, delivery will be made in accordance with delivery availability and winner’s location. If the winner selects the product prize package, all products will be shipped to the winner in accordance with the Sponsor’s delivery schedule.

Prize Restrictions: Prizes are not transferable or refundable, must be accepted as awarded and cannot be resold for profit. No cash equivalent. Fifty Bar reserves the right to, without any prior notice and at any time, replace with a similar product or the latest release of a product of the same category. Federal, state and local taxes are the responsibility of the Winners. If required by law, Sponsor will issue a 1099_MISC to Winner for the value of Prize.

6. BINDING EFFECT. By submitting your entry you agree to be bound by these Official Rules and failure to comply with these Official Rules may result in disqualification.  All federal, state and local laws apply. Void where prohibited.

7. GENERAL CONDITIONS OF PARTICIPATION. Fifty Bar’s decisions are final on all matters related to this Promotion. Fifty Bar and its Promotion Parties are not responsible for incomplete, lost, late, delayed or garbled entries, incorrect or inaccurate capture of entry information, including but not limited to technical malfunctions, human or technical error, omission, interruption, deletion, defect or failures of any mailing issues whatsoever with the United States Postal Service, so are or any combination thereof.

Only the fully completed entries are accepted.  All entries submitted become the property of Fifty Bar. Fifty Bar reserves the right, without prior notice, to terminate this Promotion, in whole or in part, or modify this Promotion in any way, and for any reason, including without limitation, if Fifty Bar determines in its sole discretion, that fraud, technical failures or any other factor beyond Fifty Bar’s reasonable control impairs the integrity of the Promotion. Fifty Bar reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the application or voting process or to be acting in violation of these Official Rules. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion is a violation of criminal and civil law, and should such an attempt be made, Fifty Bar reserves the right to seek damages from any such person to the fullest extent permitted by law. Fifty Bar’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

By participating in this Promotion, participant releases and agrees to hold harmless Fifty Bar and its Promotion Parties from any and all liability with respect to acceptance, possession or use (misuse), or failure to use any matters arising out of or relating to this Promotion or any prize.

8. PUBLICITY RELEASE. Except where prohibited by law, acceptance of a prize shall constitute the Winner’s agreement with Fifty Bar may to use their name, address, voice, likeness and prize information for promotional purposes without further payment or compensation, unless prohibited by law.

9. PRIVACY; DATA COLLECTION. Information provided by you for this Promotion is subject to Sponsor’s privacy policy located at www.thefiftybar.com.

10. SPONSOR. The Promotion is sponsored by Fifty Bar headquarter offices at 4500 S. Pleasant Valley Road, Suite 105, Austin, Texas 78744.

11. WINNER LIST.  Winner may be announced on Fifty Bar social media outlets, however, you may also receive the winner’s information by sending a self-addressed, stamped envelope to Fifty Bar no later than 60 days from the end date of the Promotion Period. Residents of Vermont may omit return postage.

12. DISPUTES.  Entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this Promotion, other than the administration of the Promotion, shall be resolved individually, without resort to any form of class action, and exclusively by a court having competent jurisdiction located in Los Angeles County, California, U.S.A.; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion but in no event attorneys’ fees; and (c) under no circumstances will registrant be permitted to obtain awards for, and registrant hereby waives all rights to, claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Fifty Bar in connection with the promotion, shall be governed by, and construed in accordance with, the laws of the State of California, U.S.A., without giving effect to any choice of law or conflict of law rules.
